SYNOPSIS
Payment has always been a major problem in construction industry. To overcome this problem, a dispute resolution process known as adjudication was introduced in UK and thereafter to Australia, New Zealand and Singapore.
Construction Adjudication is a ‘rough and ready’ dispute resolution process available to almost all parties to construction contracts. It is meant to provide for a swift interim dispute resolution process. Its primary purpose is to provide an interim solution to a dispute in order to maintain cash flow through the supply chain, from the manufacturers of building materials to sub-contractors and eventually to Main Contractors. The adjudication can either be a contractual or statutory procedure.
Followed other countries, Malaysia had enacted the Construction Industry Payment and Adjudication Act 2012 (CIPAA) which will provide statutory adjudication to parties involved in payment disputes. The Act had taken effect since 15th April 2014. There are, till June 2015, more than 100 cases being filed for adjudication in KLRCA. Thus the parties are now able to resolve their payment disputes via statutory adjudication under the Act.
This Seminar aims to provide the procedure required under the Act for Statutory adjudication and also the potential problems that parties may encounter.
ABOUT THE COURSE LEADER
Ir. Lai Sze Ching graduated as a Mechanical Engineer from the University of Malaya. He also holds LL.B degree from the University of London and LL.M from the University of Malaya, majoring in Alternative Dispute Resolution, Arbitration Law, Remedy and Construction Law. In addition, he also holds a Diploma in International Commercial Arbitration (UK) and Certificate of Legal Practice from the Qualifying Board of Malaysia.
Ir. Lai has more than 30 years working experience in the field of construction and property development. He is currently the Managing Director of a consulting firm involved in Project and Contract Management and Contractual Claims. Ir. Lai had been invited to deliver papers on construction, water supply and sewage treatment in various international seminars and conferences. He had also written various articles on ADR, Arbitration and Construction disputes and had conducted talks on Law for Engineers and on Construction Law to local companies and Universities.
Being an accreditor of Engineering Accreditation Council Malaysia, he is also actively involved in the accreditation of local engineering programmes. He is currently a member of the Industry Advisory Panel for Lim Kok Wing University of Creative Technology and Multimedia University. Ir. Lai has also been appointed as the Student Ambassador for the External Law Programme of University of London. He is empanelled as Arbitrator, Mediator and Adjudicator in the panel of Kuala Lumpur Regional Centre of Arbitration (KLRCA).
